What MyOcto is

MyOcto is a tool for an independent service provider to run their own business from their phone: keep a private client book, compose messages and payment requests and hand them to your own apps, exchange contact cards with trusted peers, and — if you choose — publish a simple public page. By using MyOcto you agree to these terms.

What MyOcto is not

MyOcto is not a marketplace, an agency, or a middleman. It never sends a message for you, never takes or moves money, never takes a cut, and never decides who does what work. It composes; you send. Your relationship with your clients, and with any peer you introduce, is entirely your own.

Who can use MyOcto

You must be at least 18 years old. MyOcto is made for independent providers to use for your own business, and you use it in that capacity.

Your account

You sign in with a one-time code. Keep your phone and your account secure; you are responsible for what is done through your account. You can sign out (which ends the session on our server) or delete your account at any time.

Your clients are yours — and your responsibility

The people in your client book are your business and your responsibility. If you are subject to data-protection law where you operate, you are the one responsible for the personal data you keep about your own clients. MyOcto keeps that data only on your device to help you meet that responsibility, not to take it on for you.

Your work, your permits

You confirm that you hold every licence, permit and insurance your work requires, and you are responsible for ensuring that the services you offer meet the requirements that apply where you work, including any required registrations, licences, permits, qualifications and insurance. You set your own prices. MyOcto does not check any of this. Using MyOcto does not authorise you to provide any service.

Independent, on every side

You and MyOcto are independent. MyOcto is not your employer, agent or partner, and using MyOcto does not make you an employee, agent or partner of MyOcto or of anyone you exchange cards with.

Colleagues you introduce

You choose who is in your circle and whom you introduce to a client. MyOcto does not vet, recommend or vouch for anyone, and does not guarantee anyone's work, availability or conduct. Anything you agree with a colleague — who does the work, who is paid, how much, and when — is between you and that person alone. MyOcto is not a party to it.

Money and taxes

Your clients pay you through your own payment providers, never through MyOcto. You are responsible for your prices, invoices, receipts, taxes and refunds, and for following the rules of the payment providers you use.

Messages you send

MyOcto drafts a message; you read it, can change it, and send it yourself from your own apps. You are responsible for what you send and for having the right to contact the person you send it to.

Other apps and services

MyOcto hands your messages to apps such as WhatsApp, your text messages or your email, opens maps, and may show third-party information such as flight times. Those apps and services are run by others under their own terms; MyOcto does not control them and is not responsible for them or for errors in the information they provide.

Your data on your phone

Your client book lives on your phone. Keeping your phone safe and making backups is up to you. Backups are locked with a passphrase you choose; we never see it, so we cannot recover a lost backup passphrase, and we cannot recover data from a lost or reset phone that was not backed up.

Location and directions

Sharing where you are is always your choice and can be turned off at any time. Directions, distances and arrival times are estimates and may be wrong. Do not use MyOcto in a way that distracts you while operating a vehicle.

Using MyOcto fairly

You agree not to use MyOcto to break the law, to offer a service you are not allowed to offer, to send spam or harass anyone, to collect other people's information without a right to, or to interfere with, probe or copy the service or the people who use it.

Publishing a public page — the rules

A public page is optional. If you publish one, you agree that:

We may take down a page or a photo that breaks these rules or that is reported, and we keep a record of such actions. You can take your own page down at any time.

Free period and plans

To add clients and send messages you need to be signed in; a sign-in lasts about a month, after which the app asks you to sign in again (this needs a connection). MyOcto is free for 90 days from your first sign-in on your account, once per account. After that there are 14 days of grace, and then MyOcto becomes read-only until you buy a plan: you can no longer add or change clients, hand messages to your apps, introduce colleagues, publish or update a public page, or share your location. Whatever happens, you can always see, export and delete your own data, take a public page down, and leave a group. Nothing is charged today; before any charge, this section will state the price, the billing period, how renewal and cancellation work, and the refund policy.

What you can expect from us

We work to keep MyOcto available and secure, but we provide it "as is" and cannot promise it will never be unavailable or error-free. To the extent the law allows, we are not liable for indirect or consequential losses, lost income or lost data, or for what you, your clients or your colleagues do. Where we are liable, our total liability is limited to the greater of what you paid us in the 12 months before the claim and 100 euro.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, intent or gross negligence, or for anything else the law does not allow to be limited. None of this limits any rights you have as a consumer that cannot be waived.

If a claim comes from your business

To the extent the law allows, if a claim is made against MyOcto because you broke these terms or the law — including in the services you provide or the messages you send — you will cover the reasonable losses and costs that result, except to the extent MyOcto caused them. We will tell you about such a claim promptly and let you take part in answering it, and we will not settle it in your name without your agreement.

What belongs to whom

You keep what is yours: your client book, your messages and what you put on a public page. If you publish a page, you allow us to store it and to show it publicly while it is published. After you take it down we stop showing it, and we keep the stored copy only as our privacy policy describes. We own MyOcto itself — the app, the site and their design and code.

Events outside our control

We are not responsible for a delay or failure caused by events outside our reasonable control, such as a network or power outage or a failure of a service we depend on.

Ending it

You can stop using MyOcto and delete your account at any time. We may pause your access — making MyOcto read-only for your account — or end an account that breaks these terms, that does not pay a charge that is due, or that we must act on for legal or security reasons; where we reasonably can, we will tell you why. While paused, you can always see, export and delete your own data.

Governing law

These terms are governed by the law of the State of Nevada, USA, without affecting any mandatory consumer-protection rights you have where you live.

If one part does not hold

If a court finds part of these terms unenforceable, the rest of these terms still apply. Not enforcing a term straight away does not mean we give it up.

Changes

We may update these terms. Each version has its own revision number, shown at the top. When we change them, we will ask you to accept the new terms in the app before they apply to you; until then, the version you accepted applies.
